HANSON CONSERVATION COMMISSION
MINUTES OF THE PUBLIC MEETING OF DECEMBER 16, 2008
TOWN HALL, 542 LIBERTY STREET, HANSON, MA

Called to Order at 7:30 PM under M.G.L. Chapter 131, s.40 and the Hanson By-Law 3-13, s.5. by Philip R. Lindquist, Chairman, in Meeting Room A at the Town Hall.

Enforcement

60 Bowker Avenue
Mr. Vacca updated the Commission as to the enforcement order issued against the homeowners  that had a deadline of 10/6/08 to complete the work.  After recently conducting a site visit, he determined that they had not finished the conditions of the restoration.  Mr. Vacca sent a letter for failure to comply with the EO with a warning of possible fines.  A second site visit was planned with the consultant and homeowner to discuss compliance.  The homeowners were given a new deadline of 4/15/09 to finish up the restoration.  A receipt for the purchase of shrubbery must be submitted to the Commission as proof of good faith effort and the fines were stayed.     
Adams Circle
Mr. Vacca reported that he had received a letter from Dick Harris, Highway Supervisor, that a culvert was clogged with landscape debris and they had cleaned it out per the Memorandum of Agreement.  Mr. Harris asked if Mr. Vacca would investigate who was dumping in that area.  Mr. Kemmett suggested that the Commission publish a newspaper article in the Fall about not throwing yard waste into wetlands so as to educate homeowners about composting.

Mr. Vacca reported to the Commission that he and Mr. Harris had made an inspection of the trailer today and noted the following:  the fireplace was gone as well as the chimenia and the hazardous material had been removed from Conservation jurisdiction as requested.  Mr. Colburn indicated to them that they were moving out of the trailer to a rented house nearby.  However, under his farm plan, he is allowed to do certain agricultural activities with approval from Conservation.  He will come in next spring for a consultation prior to such activities.    
        Mr. Bruce Young, an abutter on Indian Head Pond attended the meeting to voice his concern about compliance.  He mentioned that the Hanson Board of Assessor’s had denied an agricultural exemption for this particular bog.  Mr. Lindquist requested that Mr. Vacca follow up with the Assessor’s regarding the trailer and the 61A designation.  
        Mr. Schellenger requested that proof of a purchase and sales agreement of the bog should be submitted as well.
